Terms of Service

1. Agreement to Terms
By accessing or using Pear MCP ("the Service"), operated by Ashton Turner ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Pear MCP is a software-as-a-service platform that connects AI assistants to your Apple iCloud Calendar, Reminders, Contacts, and Mail via CalDAV/CardDAV/IMAP/SMTP protocols. We provide a remote MCP (Model Context Protocol) endpoint and related dashboard tools that AI clients can connect to.
3. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your email account, Pear session, API keys, OAuth-connected clients, and Apple app-specific passwords. You must not share your API key with unauthorised parties. We reserve the right to suspend or terminate accounts that violate these terms.
4. Apple iCloud Credentials
The Service requires an Apple app-specific password to access your iCloud data. Your credentials are encrypted at rest using AES-256 encryption. We access your iCloud data solely to provide the Service as described. We do not store, copy, or retain your iCloud data beyond what is necessary to process each request. You are responsible for revoking app-specific passwords if you no longer wish to use the Service.
5. AI Client Actions
Pear exposes tools that your connected AI or MCP client may call when you ask it to act. Some tools can create, update, move, or delete calendar events, reminders, contacts, and emails. You are responsible for reviewing important actions, prompts, client permissions, and tool results before relying on them.
6. Subscriptions and Billing
The Service offers a free tier (50 API calls per calendar month) and a paid Pro tier. Pro is available as a monthly subscription ($4.99/mo), an annual subscription ($29/year), or a one-time Lifetime purchase ($69) via Stripe. Paid plans currently remove Pear's standard free-tier call limit, subject to fair and reasonable use. Prices are in USD; taxes may be added where required. Prices are subject to change. Existing earlier lifetime buyers remain grandfathered on their original lifetime access. See our Refund Policy for refund details.
7. Refunds and Consumer Rights
Refund requests are handled under our Refund Policy. Nothing in these Terms or the Refund Policy limits any non-excludable rights you may have under applicable consumer protection laws, including the Australian Consumer Law.
8. Acceptable Use
You agree not to:
- Use the Service for unlawful purposes
- Attempt to circumvent usage limits or billing
- Attempt to access another person's account, Apple data, or API keys
- Reverse engineer, decompile, or disassemble the Service
- Use the Service to spam, harass, or abuse others
- Share, resell, or sublicense your account access
- Exceed reasonable API usage patterns that degrade the Service for others
9. Third-Party Dependencies
The Service depends on third-party services including Apple iCloud, Stripe, Supabase, Resend, Vercel, and the AI or MCP clients you choose to connect. We are not responsible for changes, outages, policy decisions, or discontinuation of third-party services. Apple may change its CalDAV/CardDAV/IMAP/SMTP protocols, authentication requirements, or terms at any time, which may affect the functionality of the Service. We will make reasonable efforts to adapt to such changes but cannot guarantee uninterrupted service.
10. Availability and Changes
We may change, suspend, or discontinue parts of the Service as the product evolves. We may also perform maintenance, apply rate limits, or restrict access where needed to protect users, third-party services, or the Service itself.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or business interruption, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim. This clause does not limit any non-excludable rights or remedies that apply by law.
12. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. We collect and process personal data as described therein.
13. Termination
You may stop using the Service at any time by cancelling your subscription and disconnecting your iCloud account. We may suspend or terminate your access if you violate these terms. Upon termination, your encrypted credentials are deleted. Provisions that by their nature should survive termination (including liability limitations and dispute resolution) shall survive.
14. Changes to Terms
We may update these terms from time to time. We will notify users of material changes via email or an in-app notice. Continued use of the Service after changes constitutes acceptance of the updated terms.
15. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales, Australia.
